1. Acceptance of Terms
By accessing or using elmsteadremodeling.com, or by submitting a request for service through the site or by phone, a user agrees to be bound by these Terms of Service in full. If a user does not agree to these terms, they should not use the site or request services from Elmstead Remodeling. Use of the site constitutes acceptance of the version of these terms in effect at the time of that use.
2. Limitation of Liability
Elmstead Remodeling’s total liability arising out of or related to any service or use of this site is limited to the amount the customer paid for the specific service at issue. Elmstead Remodeling is not liable for any indirect, incidental, consequential, special, or punitive damages of any kind, regardless of the theory of liability and even if Elmstead Remodeling has been advised of the possibility of such damages. Some states do not allow certain limitations on implied warranties or damages, so some of the above may not apply in every case.
3. Scope of Services
Elmstead Remodeling provides professional home services in Los Angeles, CA and surrounding areas. All service offerings are subject to availability and to a professional assessment of site conditions before work begins.
Certain service requests coordinated through elmsteadremodeling.com may be carried out by independent trade professionals or partner contractors who work in conjunction with Elmstead Remodeling. By requesting service, a customer acknowledges and agrees that their job may be completed by one of these coordinated professionals.
4. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of CA, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these terms, the site, or any services provided by Elmstead Remodeling shall be brought exclusively in a court of competent jurisdiction located in CA, and both parties consent to that venue.
5. Estimates and Pricing
Any estimate provided by Elmstead Remodeling reflects the information available at the time it is given and is offered in good faith. Final pricing may differ from an initial estimate if actual site conditions, material requirements, or scope of work are found to differ materially from what was originally assessed.
If a change in price becomes necessary, Elmstead Remodeling will notify the customer before proceeding with additional work. Continuing with service after receiving such notice constitutes the customer’s approval of the revised pricing.
6. Changes to These Terms
Elmstead Remodeling reserves the right to revise these Terms of Service at any time. Updated terms will be posted to elmsteadremodeling.com with a revised effective date. A user’s continued use of the site or continued requests for service after any revision is posted constitutes acceptance of the updated terms. Users are encouraged to review this page periodically.
7. Cancellations and Rescheduling
Elmstead Remodeling requests at least 24 hours’ advance notice for any cancellation or rescheduling of a confirmed appointment. This allows the company to reallocate time to other customers and plan accordingly.
Cancellations or rescheduling requests made with less than 24 hours’ notice may be subject to a late-cancellation fee. Any applicable fee will be communicated to the customer at the time of booking or upon scheduling confirmation.
